Your Acceptance of this Privacy Policy/Modifications to this Privacy Policy

You agree, without limitation or qualification, to be bound by this Privacy Policy when you: (a) access the Site; (b) access links to our social media pages on third-party social media websites, such as Facebook, Twitter, and YouTube; and/or (c) submit a request form to be contacted by one or more disability representatives regarding the services offered Marcy Disability. We reserve the right to change, modify, add, or remove portions of this Privacy Policy. CCPA & Data Protection for California residents

The California Consumer Privacy Act (CCPA) takes effect on January 1, 2020. The intent of the CCPA is to protect the data of California residents.

Additionally, you can opt-out of any Text (SMS) messages that you may receive by replying “STOP” to be immediately removed. Requesting that we not sell your information, by clicking on the link in the footer of our Site. 

We will respond to your request as quickly as is reasonably possible, or within the period of time required by law. s easy. You understand and agree that this consent applies even if your telephone number is a wireless number. You further acknowledge and agree that you are not required to consent to the above-stated terms to gain access to the services of Marcy Disability.

 

Personally Identifiable Information vs Non-Personally Identifiable Information

We collect two types of information about our users: Non-Personally Identifiable (“Anonymous”) Information and Personally Identifiable Information. Personally Identifiable Information (“PII”) is any information that personally identifies you, such as your name, email address, or your telephone number. This personal information may be requested when you fill out an online inquiry or subscribe to our email newsletter.  You provide certain Personally Identifiable Information to us when you (a) register for our services and register your e-mail address with us; or (b) send e-mail messages, submit forms or transmit other information by telephone or letter. Examples of the types of PII you may be asked to provide on the Site include: “Contact Data,” such as your name, phone numbers, mailing address, and e-mail addresses. We may as well purchase and manage opt-in lists generated by third parties that Marcy Disability may use to supplement the PII you provide with additional PII gathered from public or third-party sources. We will also use Personally Identifiable Information to enhance the operation of our Site, improve our marketing and promotional efforts, statistically analyze Site use, improve our product and service offerings, and customize our Site’s content, layout, and services. We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices. You are under no obligation to provide PII, with your refusal to do so may prevent you from using the services of Marcy Disability or Marcy Disability from offering those services.  Marcy Disability does not request and asks that you do not provide any confidential, proprietary, or sensitive PII that does not relate to your specific case. Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Site’s Uniform Resource Locator (“URL“) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP“) address. We use your IP address to diagnose problems with our servers, software, to administer our Site, and to gather demographic information. Our third-party ad servers will also provide us with summary, but not individual reports that will tell us how many ads were presented and clicked upon at our Site. 

 

Analytics information

We may directly collect analytics data, or use third-party analytics tools and services, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any individual user.

 

Cookies

When you visit the Site, we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets Marcy Disability help you enhance your navigation through the Site. Release of Information

We do not sell, trade, or rent your Personally Identifiable Information to others. We do provide some of our services through contractual arrangements with affiliates, services providers, partners, and other third parties. We and our service partners use your Personally Identifiable Information to operate our Site.  

 

Information Sharing, Use and Disclosure

The personal information that you submit to Marcy Disability grants us the right to use your personal information for marketing purposes including, but not limited to, generally sharing such information with and/or selling such information to third parties for marketing purposes, including any business which is a subsidiary of, or under common ownership or control with, Marcy Disability and advertising partners. We will also use your personal information for customer service, to provide you with information that you may request, and/or to customize your experience on the Site.  

We also reserve the right to release current or past user information in the event that we believe that the user is using, or has used: (a) in violation of the MarcyDisability.com Terms of Use, this Privacy Policy or any other of our operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published by us from time to time; (b) to commit unlawful acts; (c) if such information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; (d) if we are sold or acquired; provided, however, that if we are involved in a merger, acquisition or sale of all or a portion of our assets, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information; and/or (e) when we deem it necessary or appropriate including, without limitation, sharing your e-mail address with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission implementing regulations. 

 

Information Security

Marcy Disability cares about the security of your information, and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Site. However, Marcy Disability cannot ensure or warrant the security of any information you transmit to Marcy Disability or guarantee that information on the Site may not be accessed, disclosed, altered, or destroyed.  

If any information under our control is compromised because of a breach of security, then Marcy Disability will take reasonable steps to investigate the situation and where appropriate, to notify by email those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. Any transmission of data at or through the Site is at your own risk.

 

Minors Privacy

Marcy Disability does not knowingly collect or solicit any information from anyone under the age of eighteen (18). The Site and its content are not directed at children under the age of eighteen (18). If you believe that we might have any information from or about a child under eighteen (18), please contact us.

 

Deleting and Updating Your Information

At your request, we will inform you of what personal information we have on file for you. In addition, at your request, we will remove and/or modify the personal information that you have provided to us, or that we have collected. You may do so by contacting us; provided, however, that we ask individuals to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, or jeopardize the privacy of others.
